1. Agreement to Terms

By accessing or using Blogberry ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Blogberry provides a software-as-a-service platform that enables users to:

• Convert blog articles and web pages into downloadable PDF documents
• Embed email capture forms on websites
• Automatically deliver PDF files to form submitters via email
• Collect and manage leads from form submissions
• Integrate with third-party services via webhooks

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account and use the Service.

4. Subscription Plans and Billing

4.1 Free Plan

The Free plan includes up to 50 form submissions per month. Usage resets on a rolling 30-day cycle from your signup date.

4.2 Paid Plans

Paid subscriptions (Early Bird plan) provide unlimited submissions and additional features. Subscriptions are billed monthly and renew automatically.

4.3 Payment Terms

• All payments are processed securely through Stripe
• Prices are in Euros (EUR) unless otherwise stated
• You authorize recurring charges to your payment method
• Failed payments may result in service interruption

4.4 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent periods
• Your account will revert to the Free plan after the paid period ends

4.5 Refunds

We generally do not provide refunds for subscription fees. However, we may consider refund requests on a case-by-case basis for exceptional circumstances. Contact us within 7 days of purchase if you believe you qualify for a refund.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Send spam or unsolicited communications
• Distribute malware or harmful content
• Collect personal data without proper consent
• Impersonate others or provide false information
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to abuse the Service
• Convert content you do not have rights to use

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you convert using our Service. By using Blogberry, you represent that you have the necessary rights to convert and distribute such content.

6.2 Our Service

Blogberry and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes in accordance with these Terms.

7. Data Collection Compliance

When using Blogberry to collect email addresses and other personal data from your website visitors, you are responsible for:

• Displaying appropriate privacy notices on your forms
• Obtaining valid consent where required by law (e.g., GDPR)
• Honoring opt-out and data deletion requests from your leads
• Complying with all applicable data protection regulations

You agree to indemnify us against any claims arising from your failure to comply with data protection laws.

8. PDF Generation and Storage

• Generated PDFs are stored temporarily for 10 days
• Download links expire after this period
• We do not guarantee permanent storage of generated files
• PDF quality depends on the source content and may vary

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency repairs or updates
• Factors beyond our reasonable control

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE"
• We disclaim all warranties, express or implied
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Blogberry and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you convert or distribute using our Service

12. Account Termination

We may suspend or terminate your account immediately, without prior notice, if:

• You breach these Terms
• We suspect fraudulent or illegal activity
• You fail to pay applicable fees
• Continued provision of service becomes impractical

You may delete your account at any time through your settings. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the competent courts.
